PRICE GUARANTEE TERMS AND CONDITIONS.

1. The Price Guarantee must be read subject to these Terms and Conditions.
2. To be eligible for The Price Guarantee you must have purchased and paid  for the product in full from the store. Within fourteen (14) days after the date of purchase, you must have found a bona fide advertised price for an identical product (including supplier and model no.) in a daily newspaper or catalogue or on commercial radio or television (photographs will not be accepted) and delivered copies and/or evidence to the store. Application for claims for the Price Guarantee can only be accepted by the store where you made your purchase.
3. The identical product must be a lower price than the price you paid for the product after all allowances, rebates, delivery, installation and discounts. The store reserves the right to verify the evidence of the identical product sold at the lower price before approving your claim.
4. If your claim qualifies for the Price Guarantee, the store will, within fourteen (14) days of approval, pay an amount equivalent to 105% of the difference between the lower price found and the Fitness Depot Price. The amount will be refunded in the same manner of tender as the original purchase. A refund will be made for each product in an invoice which qualifies for the Price Guarantee.
5. Price Guarantee does not apply where:

• the lower price is conditional, or a price determined after the allowance of any amount for, or is part of a promotion involving, financing, installation, delivery, rebates, cash back offer, free or bonus offers, trade discount, stock clearances or any limited quantity promotion; or

• the lower price is offered under any promotion with a third party (including, but not limited to, promotions with newspapers, exhibitions or other special events); or

• the lower price is not available to the general public; or

• the identical product is advertised in classifieds, online stores that have no retail shop front (including e-bay, trading post, grays online), fire or liquidation sales, rack, clearance and warehouse outlets; or

• the lower price has been discounted by the competitor by use of coupons, loyalty rewards systems, redemption of frequent flyer miles or similar and other offers or incentives to reduce the total cost; or

• the lower price has been discounted by the competitor on the basis that the product is floor stock, end of line, ex demo, second hand or similar; or

• the difference in cost between the Fitness Depot Price and the lower price is the result of an error by the competitor; or

• the store is unable to verify, using reasonable means, that the lower price is available;

1. The refund of the 105% difference between the Fitness Depot Price and the lower price is the sole and exclusive compensation that will be payable to you if you show the store did not meet its Price Guarantee, no further compensation applies..
2. This Price Guarantee may be terminated or amended at any time without notice.
3. The Price Guarantee is subject to you complying with the stores usual terms and conditions of trade.
4. The information you provide to the store will only be used to provide the Price Guarantee refund to you or to discuss with you your Price Guarantee claim. A copy of the stores privacy policy is available in store or on our website. Any privacy questions may be directed to Fitness Depot in writing by e-mailing info@fitnessdepot.com.au
